DMCA Copyright Policy

1. Commitment to Copyright Protection

FileBuddy respects the intellectual property rights of artists, creators, and copyright holders, and expects all users of our cloud storage service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512, 'DMCA'), we maintain an expeditious takedown procedure to respond to valid copyright infringement notifications regarding material hosted on or transmitted through our platform.

2. Designated Copyright Agent

3. Filing a Valid DMCA Notice

To submit an effective notice of claimed infringement under 17 U.S.C. § 512(c)(3), your written communication must include substantially the following: (a) A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest. (b) Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered. (c) Clear identification of the allegedly infringing material and information reasonably sufficient to allow us to locate it (specifically the exact FileBuddy file URLs or share links). (d) Contact information sufficient to permit us to reach you, including your name, physical address, telephone number, and email address. (e) A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law. (f) A statement, made under penalty of perjury, that the information in your notification is accurate and that you are authorized to act on behalf of the copyright owner.

4. Notice Review & Takedown Procedure

Upon receiving a valid DMCA takedown notice with all required information, FileBuddy will act expeditiously to remove or disable access to the infringing material. We will promptly notify the user responsible for uploading the content that their file has been disabled or removed, providing them with a copy of the takedown notice so that they may exercise their statutory right to submit a counter-notification.

5. Submitting a Counter-Notification

If you believe in good faith that your content was removed or disabled as a result of mistake or misidentification (such as fair use, license ownership, or clerical error), you may submit a written Counter-Notification to our Designated Copyright Agent under 17 U.S.C. § 512(g)(3). The counter-notification must contain: (a) Your physical or electronic signature. (b) Identification of the material that was removed or to which access was disabled, and the location (URL) at which the material appeared before removal. (c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. (d) Your name, physical address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Delaware, United States, if located outside the U.S.), and that you will accept service of process from the original complaining party. Upon receipt of a valid counter-notification, we will forward a copy to the original claimant. If the copyright owner does not file a court action seeking an order against the user within 10 to 14 business days, FileBuddy may restore access to the material.

6. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), FileBuddy maintains and enforces a strict repeat infringer policy. We will terminate, under appropriate circumstances and at our sole discretion, the accounts of users who are found to repeatedly infringe the intellectual property rights of others. We also reserve the right to immediately terminate accounts or disable sharing privileges for egregious or intentional infringements on a single occasion.

7. Penalties for Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be held liable for statutory damages, including court costs and attorney's fees incurred by the alleged infringer, the copyright owner or licensee, or by FileBuddy.
