Digital Millennium Copyright Act (DMCA) Policy

Welcome to FileBuddy. We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using the FileBuddy service that are reported to our Designated Copyright Agent identified below.

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our service by completing a Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

1. Notice of Alleged Copyright Infringement

To file a notice of infringement, you must provide a written communication (via email or physical mail) that includes the following details:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (specifically, the direct URLs of the files).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notifications

If you receive a notification that your content has been removed due to a copyright infringement claim, and you believe that the material was removed by mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent.

To be effective, a Counter-Notification must be a written communication that includes the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to which was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which FileBuddy may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.

4. Repeat Infringer Policy

FileBuddy takes copyright infringement very seriously. In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Misrepresentations

Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or was removed or disabled by mistake or misidentification, may be subject to liability, including costs and attorney's fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by a service provider like FileBuddy.
